Meeting called to order at 6:00 p.m. Quorum establish


Board Members present: Sheldon Shed, President; James Mylius, 1st VP. ; Colleen Witek, 2nd VP.
Theresa Morehous, secretary.


Non-board members present: 7 Property owners


Secretary’s Report:

· July 2, 2024 minutes were read. Colleen made a motion to accept the minutes as read, Jim 2nd, motion passed 4-0.

Treasurer’s Report:

Balances as of July 31, 2024

Deposits: $0.51

Debits: $390.94 (Mowing, FELPS, copies)

Checking balance: $11,883.24 Edward Jones: $40,075.00 Report Balance: $51,958.24


Sheldon made a motion to approve the treasurer’s report, Colleen  2nd the motion. Motion passed 4 -0.


Review of CC&R’s – Updates

· Committee Members: Anthony Archer.

· Ballot looks great; Sheldon has review and waiting to get to the attorney.

· Scheduled voting for October 2024.

· Anthony will check to see if all 3 parts are combined of the CC&R’s.

· CC&R review committee is released.


ACC:

· 135 Montesito- ducks present. Not resolved as previously reported. It will be investigated further. Game warden stated these are pet ducks. Charlie has visited 3 times but will go again and talk to resident.

· 242 S Palo Alto-chickens. Sheldon notified the resident of attorney fees for variance and fees offered by the board to file with the county court house.  Resident has not taken action to remove the fowl or indicated that they would accept the board’s offer of the variance.  The property owner is admittedly not in compliance.  2nd letter of violation is going out Aug 7th.

· 118 Chaparral-omeowner Stacy Collins stated she has no ducks. Ducks and geese that do show up on her property are migrant and she has no control.abandoned automobiles- 1stletter went out June 5th, 2024. 2nd letter went out July 5th. No response from resident. 3rd letter of violation going out Aug 6th.

· 126 Encino-property exterior not complete/affecting community value -Charlie will contact property owner.

· 115 Sky Hawk-roosters. 1st letter going out Aug 6th.

· Quicker response from the ACC is needed, comments from the property owners survey reinforces the need.


Old Business:

· Spectrum- Sheldon met with Spectrum on July 12, 2024, asked the Project Manager and Construction Manager to make sure common areas are smoother so maintenance equipment was not impacted (Mowing).  The Internet message will remain on the front page until the infrastructure work is complete.  Any property owners that do not feel that the easement has been returned to its original or better condition is urged to contact the Secretary.

· Aqua TX- Sheldon contacted Peggy Kimble at Eagle Creek Ranch Owners Association to see if they would like to present a united front against the quality and service issues and present an article of concern in newspaper together.  Wilson County News said they do not have an investigative reporter and suggested sending a letter to the editor.  Eagle Creek Ranch Owner Association president stated they have sued Aqua Texas 3 times unsuccessfully.

· Insurance Renewal - Colleen researched and received 5 bids.  These will be reviewed.

            Farmers Insurance       $  5,735.00

           Appalachian UW           $5,145.00

           ARM Ins Agency           $6,119.00

           Insurica (Current Carrier)    $7,322.48 - $  7,944.20   (6-15% increase over last year)


· Discussion about 11030 FM 775. Sheldon made a motion that the board will designate Sheldon Shed and Jim Mylius to have the authority to work with Amy McLin, Attorney at Law. Colleen Seconded. Motion passed 4-0.

                 § Hearing on a Temporary Injunction (TI)

                 § Final trial or a settlement is reached.


New Business:

· Balloting Committee for the CC&R’s was formed. Anthony Archer will chair this committee.


Sheldon made a motion to adjourn the meeting at 6:43 pm., Colleen seconded. Motion passed 4-0.
